Los Tres Tipos de Procedimientos de Asilo

🔴 Miedo Creíble (Credible Fear)

Primera evaluación para personas detenidas en la frontera o en centros de detención. El oficial determina si existe una base "creíble" para el temor de persecución. Es la puerta de entrada al proceso de asilo.

🟡 Asilo Afirmativo

Para personas que no están en proceso de deportación. Se solicita ante USCIS dentro de un año de la llegada. Entrevista con un oficial de asilo en una oficina de USCIS.

🔵 Asilo Defensivo

Para personas en proceso de deportación. Se presenta ante un juez de inmigración en la Corte de Inmigración de Tampa (IJ). Mayor urgencia y consecuencias más severas si no se aprueba.

El Rol del Intérprete en Cada Etapa

En la entrevista de Miedo Creíble: el oficial hará preguntas directas y específicas sobre los eventos que causaron su temor. La precisión es crítica — un término mal interpretado puede cambiar completamente el peso de su testimonio. The Three Types of Asylum Proceedings

🔴 Credible Fear Interview

Initial screening for people detained at the border or in detention centers. The officer determines if there is a "credible" basis for fear of persecution. It is the gateway into the asylum process.

🟡 Affirmative Asylum

For individuals not in removal proceedings. Filed with USCIS within one year of arrival. Interview with an asylum officer at a USCIS office.

🔵 Defensive Asylum

For individuals in removal proceedings. Presented before an immigration judge at the Tampa Immigration Court (IJ). Higher urgency and more severe consequences if not approved.

The Interpreter's Role at Each Stage

Credible Fear interview: The officer asks direct, specific questions about the events that caused your fear. Precision is critical — a mistranslated term can completely shift the weight of your testimony. I've interpreted in high-pressure federal environments where accuracy has no margin for error.

Affirmative Asylum: The interview is more structured and conducted in a formal setting with the USCIS asylum officer. The interpreter must preserve the exact register of the applicant's tone — emotions are also evidence.

Defensive Asylum: The interpreter works in coordination with defense counsel and under the direction of the judge. Everything goes on the judicial record. An interpretation error can be used against you on appeal.

Critical warning: In asylum proceedings, using an uncertified interpreter or one without experience in legal contexts can invalidate your testimony. The judge or officer has authority to suspend the proceeding if interpretation quality is questionable.
